Earlier this year, the America Legal First Legal Foundation (AFL) demanded an investigation by the DOE's Office for Civil Rights (OCR), alleging that the district mishandled and failed to respond appropriately to reports of sexual misconduct.

AFL, “a national, nonprofit organization that works to promote the rule of law in the United States,” said in a victory letter that the school “infamously mishandled sexual assault incidents that resulted from a 'non-binary' male student entering the girls’ bathroom and assaulting a female student, acting with deliberate indifference to allegations of sexual assault and harassment and willfully ignoring its Title IX obligations.”

Following their demand, the Department of Education advised AFL that it has opened a Title IX investigation into Loudoun schools.

“It is paramount that our public schools enact and enforce policies to keep students safe while at school,” AFL Senior Advisor Ian Prior said in a statement. “A special grand jury report demonstrated that Loudoun County Public Schools woefully failed in that respect, in part because of the utter lack of a competent Title IX process.

“We are pleased that the Department of Education has opened an investigation into this dereliction of duty.”

In a statement this week, Loudoun County Public Schools officials acknowledged the notice of complaint and said they would be cooperating with investigators.

“The staff and administration remain committed to making student safety and welfare the highest priority,” they said. “As this investigation relates to matters concerning student privacy, we will not comment further.”
